1. Information about us

2. The artworks

The images of the artworks on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your device’s display will accurately reflect the colour of the artworks.

3. How we use your personal information

If you would prefer not to be added to our mailing list after you have purchased a painting, please let us know and we will remove you. Alternatively, please email us if you would like to be sent information about new works or future exhibitions. We do not take payment through this website, so none of your payment details are known to or stored by us.

4. If you are a consumer

As a consumer, you have legal rights in relation to artworks that are faulty or not as described. Advice about your legal rights is available from your local Citizens’ Advice Bureau or Trading Standards office. Nothing in these Terms will affect these legal rights.

5. How the contract is formed between you and us

Please take the time to read and check your order carefully at each stage of the order process.

All artworks shown on our site are subject to availability. After you place an order, you will receive an email from us acknowledging that we have received your order. Product availability will be confirmed to you within 7 days (the “Order Confirmation”). Once you have our Order Confirmation, a binding contract will be formed between you and Emilia Momen for purchase of the artwork and your payment will be processed. You will receive a dispatch confirmation from us once your artwork has been dispatched for delivery (the “Dispatch Confirmation”).

If we are unable to supply you with an artwork — for example because it is not in stock, no longer available, or because of an error in the price on our site — we will inform you by email and will not process your order.

If, following Order Confirmation and processing of your payment, the artwork is no longer available, we shall refund any payment taken from you in the same way you used to pay for the artwork.

6. Our right to vary these terms

We may revise these Terms from time to time in the following circumstances: (a) changes in how we accept payment from you; (b) changes in how we conduct business; or (c) changes in relevant laws and regulatory requirements. Every time you order artworks from our site, the Terms in force at that time will apply to the contract.

7. Your cancellation rights if you change your mind

As a consumer you have a legal right to change your mind and cancel a contract under the Consumer Contracts Regulations 2013. This means that during the relevant period, if you change your mind or for any other reason decide you do not want to keep an artwork, you can notify us of your decision to cancel the contract and receive a refund. Advice about your legal right to cancel is available from your local Citizens’ Advice Bureau or Trading Standards office.

You may cancel a contract from the date you receive the Order Confirmation, which is when the contract between you and us is formed. If the artwork has already been delivered to you, you have a period of 14 (fourteen) days in which you may cancel, starting from the day you receive the artwork.

To cancel a contract if you change your mind, you must contact us in writing by sending an email to studio@emiliamomen.com.

If you have received the unwanted artwork after changing your mind, you must pay the cost of all postage, including returning it to us, unless we have agreed otherwise. We will process the refund due to you in the same way you used to pay for the artwork, without undue delay and in any event no later than 14 days after we have received the returned artwork.

If the artwork was delivered to you: (a) you must return it to us in accordance with our returns policy and within 14 days of receipt — unless the artworks were split into different deliveries over different days, in which case you must return them within 14 days from the date the last artwork was received — in the original packaging and including any certificates provided with the artwork; and (b) you have a legal obligation to keep the artwork in your possession and to take reasonable care of it while in your possession.

If you have returned the artwork because it is faulty or mis-described, we will refund the price of the artwork in full, along with any applicable delivery charges.

As a consumer, you will always have legal rights in relation to artworks that are faulty or not as described. These legal rights are not affected by the returns policy. The seller is under a legal duty to supply artworks that are in conformity with the contract.

8. Delivery

The cost of delivery will be as notified to you before you place your order. We will deliver the artworks to you as soon as reasonably possible and in any event within 30 days after the day on which your order is confirmed. If supply of the artworks is delayed by an event outside our control, we will contact you as soon as possible and take steps to minimise the effect of the delay.

Delivery will be completed when the artworks are delivered to the address you give us.

The artworks will be your responsibility from the completion of delivery.

You own the artworks once we have received payment in full, including all applicable delivery charges.

We may need certain information from you so that we can supply the artwork to you — for example, your full name, address, email address and contact telephone number. If so, this will have been notified to you before you place your order, and we will contact you to ask for this information.

9. How to pay

Payment will be arranged with you directly at the time of purchase. If you think that a payment which has been debited from your account is wrong, please contact us promptly to let us know.

10. Communications between us

When we refer, in these Terms, to “in writing”, this will include email.

If you wish to contact us in writing, or if any clause in these Terms requires you to give us notice in writing, you can send this to us by email at studio@emiliamomen.com. We will confirm receipt by contacting you in writing, normally by email.

If we have to contact you or give you notice in writing, we will do so by email or by pre-paid post to the address you provide to us in your order.
